In everyday conversations, people put forward versions of events and provide supporting evidence to build a credible case. In environments where there are potentially competing versions, case-building may take a more systematic format. Specifically, we conducted a rhetorical analysis to consider how in child mental health settings, families work to present a credible ‘doctorable’ reason for attendance. Data consisted of video-recordings of 28 families undergoing mental health assessments. Our findings point to eight rhetorical devices utilised in this environment to build (...) a case. The devices functioned rhetorically to add credibility and authenticate the case being built, which was relevant as the only resource available to families claiming the presence of a mental health difficulty in the child was their spoken words. In other words, the ‘problem’ was something constructed through talk and therefore the kinds of resources used were seminal in decision-making. (shrink)

The meaning of intelligence has varied across time and place, with these varied constructions holding consequences for people and society at large. There is, however, little consensus around what intelligence actually means and how the construct should be applied. Educational discourses, including textbooks used to train teachers, have commonly been the site for the dissemination of ‘authoritative’ information surrounding intelligence. In this article, we present findings from a discourse analysis informed by discursive psychology of passages related to defining and measuring (...) intelligence taken from 10 educational psychology textbooks designed for university students studying to become teachers. Our research question was: How is the dilemmatic nature of the construct of intelligence managed in introductory educational psychology textbooks at the level of discourse? We discuss the function of sequencing and topic displays and how the textbook authors navigated the ideological dilemmas surrounding the construct of intelligence. We conclude by pointing to the implications for teacher training and the importance of social constructionist projects that place into question presumably ‘real’ psychological constructs. (shrink)

Integral to the diagnosis of autism spectrum disorder is the initial assessment through which the existence of a ‘problem’ is first ascertained. Despite this, there remains limited research on this early part of the diagnostic pathway. In this article, we utilised conversation analysis to examine relevant issues in relation to the practitioner–family interactions that take place within this initial assessment context. Our findings illustrated that parents typically first raised the possibility of the presence of an autism spectrum disorder diagnosis through (...) ‘building a case’, which professionals were then able to ratify or negate. Furthermore, we found that the assessments unfolded sequentially and clinical decisions were typically reached through a distinctive pattern of interaction. A distinction has been drawn between basic conversation analysis and applied CA. Applied CA has become especially beneficial for informing areas of practice such as health, social care and education, and is an accepted form of research evidence in the scientific rhetoric. There are different ways of undertaking applied CA, with different foci and goals. In this article, we articulate one way of conducting applied CA, that is especially pertinent for practitioners working in different fields. We conceptualise this as Reflective (...) Interventionist CA. We argue that this approach to applied CA is important because of its emphasis on the reflective stance that is valuable to an understanding of research data, its commitment to collaboration with practitioners, and its inductive style. In this paper, we outline the core premises and benefits of this approach and offer empirical examples to support our argument. To conclude, we consider the implications for evidence-based practice. A great deal of research has examined computer-mediated communication discussions in educational environments for evidence of learning. These studies have often been disappointing, with analysts not finding the kinds of ‘quality’ talk that they had hoped for. In this study we draw upon elements of discursive psychology as we oriented to what was happening in the talk from the participants’ perspective in addition to what should be happening from the researcher/instructor perspective. We examine the talk of undergraduate nutrition science students (...) within web logs, exploring ways in which the students, when asked to make blog posts on their beliefs about and experiences with dietary supplements, display knowing in dynamic and fluid ways. We analyzed 152 blog posts students were asked to make prior to attending the lecture on the topic. Our findings point to how students negotiate and at times resist doing being a knowledgeable student, using disclaimers such as ‘I don’t know’ and script formulations to minimize accountability for their posts. Our findings highlight how students oriented to the blogs as a venue for institutional talk, responding to the required academic task while simultaneously managing their identities as students. Olson I am grateful to Jessica Benjamin for making the time to write a letter concerning her experiences in 1979 at "The Second Sex Conference," where Audre Lorde delivered her speech "The Master's Tools Will Never Dismantle the Master's House." The letter arrived on 4 March 2000, after I (...) had sent the final version of the essay on Lorde's speech to Philosophy and Rhetoric. Although the editor indicated that, despite the late date, it would be possible for me to revise the essay to account for Ms. Benjamin's statement, I instead asked the editor to publish the statement as a comment after the essay, because of the historical value of her firsthand experiences and understandings of the conference, and because her letter provides an opportunity to engage in a dialogue called for in the conclusion of my essay. In addition, the letter gives additional information about context, which impacts any interpretation of Lorde's speech. As such, it becomes an occasion to reflect on interpreting rhetorical texts in historical contexts.As a rhetorical critic, I have been working, periodically, on understanding the rhetoric of Lorde's speech for about three years now. During September 1997, I wrote to several scholar-activists who were well positioned to know about the audiences at the conference and whether there were audio or video recordings of the speech. I was anxious to secure a recording because I knew from my earlier experience in researching Lorde's other speeches that, at times, she revised the texts for printed versions of them. Except for archivists at New York University, nobody replied to my letters. In the meantime, I presented preliminary drafts of my interpretation of Lorde's speech at conferences of the National Communication Association--one paper analyzing the speech itself and a second on later critical commentaries on it. In addition, in undergraduate classes on rhetorical criticism, I used the speech as a sustained example during class discussions on doing rhetorical criticism. In addition to reading Simone de Beauvoir's The Second Sex (1949) because its publication was the basis for the entire [End Page 291] conference, I read some conference participants' later publications based on their conference papers. Having secured a formal acceptance of my essay, I decided to send a penultimate copy of it to the scholar-activists to whom I had written in 1997, hoping that it might elicit some replies. Two people sent letters during the last couple of months, one so brief that it would not have affected my interpretation of Lorde's speech. Ms. Benjamin's letter, however, mattered to me--both because of its historical importance in its own right and because of the ramifications it has for interpretations in the essay.My immediate response to the first paragraph of Ms. Benjamin's letter was defensiveness. It disturbed me to realize that Ms. Benjamin had experienced my essay as perpetuating the divisiveness and polarization at the time and as marginalizing her experiences. My intentions were not to continue a destructive practice, but rather to examine Lorde's rhetoric to identify pitfalls in coalition politics across multiple differences (both within and among social groups) to mitigate them to the extent possible. Subsequently, I realized that my own defensiveness exemplified one such pitfall. By asking the editor to publish Ms. Benjamin's letter, I could perhaps model a dialogue approach, which I had called for in the essay's conclusion; rectify in some measure the marginalization of Ms. Benjamin's account; and provide readers with additional information for their active reinterpreting of the speech, essay, and letter.Further, based upon Ms. Benjamin's letter, some aspects of the rhetorical context may merit attention in revising my essay. In response, institutional review boards (IRBs) are being turned to as a familiar model of governance. Here, we examine the IRB model as a form of ethics oversight for health research that uses AI. A number of examples of studies from the field ‘The Philosophy of Mathematical Practice’ (PMP) are given. To characterise this new field, three different strands are identified: an agent-based, a historical, and an epistemological PMP. These differ in how they understand ‘practice’ and which assumptions lie at the core of their investigations. In the last part a general framework, capturing some overall structure of the field, is proposed.

The nonlinearity of a composite system, whereby certain of its features (including powers and behaviors) cannot be seen as linear or other broadly additive combinations of features of the system's composing entities, has been frequently seen as a mark of metaphysical emergence, coupling the dependence of a composite system on an underlying system of composing entities with the composite system's ontological autonomy from its underlying system. But why think that nonlinearity is a mark of emergence, and moreover, of metaphysical rather (...) than merely epistemological emergence? Are there diverse ways in which nonlinearity might enter into an account of properly metaphysical emergence? And what are the prospects for there actually being phenomena that are metaphysically emergent in any available sense? Here I explore the mutual bearing of nonlinearity and metaphysical emergence, with an eye towards answering these and related questions. (shrink)

Recent arguments for the basic status of economic liberty can be deployed to show that all liberty is basic. The argument for the basic status of all liberty is as follows. First, John Tomasi’s defense of basic economic liberties is successful. Economic freedom can be further defended against powerful high liberal objections, which libertarians including Tomasi have so far overlooked. Yet arguments for basic economic freedom raise a puzzle about the distinction between basic and non-basic liberties. The same reasons that (...) economic liberties and the traditionally defined list of basic liberties are basic can also be given for all other liberties. Therefore, high liberals and Rawlsian libertarians ought to accept almost all other liberties as basic, even liberties that may strike us as trivial, silly, or unimportant. This claim has revisionary implications for high liberalism. Namely, liberals should endorse strong institutional protections for almost all liberties, even at the expense of other social values. Why believe Hume's Dictum, according to which there are, roughly speaking, no necessary connections between wholly distinct entities? Schaffer suggests that HD, at least as applied to causal or nomological connections, is motivated as required by the best account of of counterfactuals---namely, a similarity-based possible worlds account, where the operative notion of similarity requires 'miracles'---more specifically, worlds where entities of the same type that actually exist enter into different laws. The main cited motivations for such an account of similarity are (...) first, that some salient contexts presuppose CF asymmetry, and second, that accounts of CFs failing to presuppose CF asymmetry are epistemologically problematic, such that under conditions of determinism, the variations in initial micro-conditions needed to implement a given counterfactual antecedent would result in so many changes to macro-states that evaluation of CFs would be rendered practically impossible. Against the first reason, I argue that no non-artificial contexts presuppose CF asymmetry; against the second, I observe that such micro-variation is compatible, in principle, with significant similarity as regards macroscopic states of affairs---enough, in particular, to allow CFs to be appropriately evaluated. I argue that there are such things as nomological probabilities—probabilities that play a certain explanatory role with respect to stable, long-run relative frequencies. Indeed, I argue, we should be willing to accept nomological probabilities even if they turn out to be metaphysically weird or even wholly sui generis entities. I then give an example of one way in which this argument should shape future work on the metaphysics of chance by describing a challenge to a common group of analyses of (...) objective probability—Humean analyses— understood as analyses of nomological probability. According to received wisdom, Kant takes the laws of logic to be normative laws of thought. This has been challenged by Tolley (2006). In this paper, I defend the received wisdom, but with an important modification: Kant's logical laws are constitutive norms for thought. The laws of logic do tell us what thinking is, not because all thoughts are in conformity with logical laws, but because all thoughts are, by nature, subject to the standard of logic.

Public officials should compensate the victims of wrongful conviction and enforcement. The same considerations in favor of compensating people for wrongful conviction and enforcement in other cases support officials’ payment of reparations to the victims of unjust enforcement practices related to the drug war. First, we defend the claim that people who are convicted and incarcerated because of an unjust law are wrongfully convicted. Although their convictions do not currently qualify as wrongful convictions in the legal sense, we argue that (...) the same reasons for legally recognizing other wrongful convictions support conceiving of these cases as wrongful convictions. If so, then people who suffered wrongful convictions associated with unjust laws, like others who were wrongfully convicted, are entitled to compensation and reparation. We then argue that America’s drug laws are unjust laws. Therefore, people who were convicted of nonviolent drug offenses are entitled to compensation. (shrink)

The article discusses the phenomenon of Russian Neo-Kantianism in the early twentieth century, looks at the main reasons for interest in Neo-Kantianism, and analyzes why German Neo-Kantian centers were so popular among Russian students and scholars at the turn of the twentieth century. The author points to the institutions where Neo-Kantianism took root and introduces the individuals who became the leaders of these institutions. The article gives a detailed overview of the themes and issues that occupied Russian Neo-Kantians before 1917, (...) as well as the development of these issues in the postrevolutionary period both in Soviet Russia and by Russian Neo-Kantians abroad. The aim of this paper is to observe the evolution and evaluate the 'realness' and authenticity in Anatomy Art, an art form I define as one which incorporates accurate anatomical representations of the human body with artistic expression. I examine the art of 17th century wax anatomical models, the preservations of Frederik Ruysch, and Gunther von Hagens' Body Worlds plastinates, giving consideration to authenticity of both body and art. I give extra consideration to the works of Body Worlds since the (...) exhibit creator believes he has created anatomical specimens with more educational value and bodily authenticity than ever before. Ultimately, I argue that von Hagens fails to offer Anatomy Art 'real human bodies,' and that the lack of bodily authenticity of his plastinates results in his creations being less pedagogic than he claims. In this paper, I discuss how information theory has been used in the study of animal communication, as well as how these uses are justified. Biologists justify their use of Shannon’s information measures by the work they do in allowing for comparisons between different organisms and because they measure a quantity that is purported to be important for natural selection. I argue that there are problems with both sorts of justification. To make these difficulties clear, I focus on the use (...) of Shannon’s information measures to quantify the amount of information transmitted by the fire ant’s odor trail and the honeybee’s waggle dance. Both of these systems are relatively simple and well understood, and the application of Shannon’s information measure to these systems initially seemed very promising and relatively straightforward. They are therefore particularly suitable for revealing the benefits and difficulties of applying Shannon’s information measures to biological systems in general, and animal communication systems in particular. In Semitic languages, the consonantal root is central to morphology, linking form and meaning. While psycholinguistic studies highlight its importance in language processing, the role of meaning in early lexical access and its representation remain unclear. This study investigates when meaning becomes accessible during the processing of Maltese verb forms, using a computational model based on the Discriminative Lexicon framework. Our model effectively comprehends and produces Maltese verbs, while also predicting response times in a masked auditory priming experiment. Results show (...) that meaning is accessible early in lexical access and becomes more prominent after the target word is fully processed. This suggests that semantic information plays a critical role from the initial stages of lexical access, refining our understanding of real-time language comprehension. Our findings contribute to theories of lexical access and offer valuable insights for designing priming studies in psycholinguistics. Additionally, this study demonstrates the potential of computational models in investigating the relationship between form and meaning in language processing. (shrink)

It is an interesting paradox that on the one hand intemperate enthusiasm greets new medical discoveries. On the other hand, the lack of science in medicine is paraded from time to time, usually as a matter of apologetics, as, when a physician wishes to excuse an error, a lawyer to discredit a physician, or a jury to render a verdict contrary to medical evidence. Philosophers who insist on the mathematical or quantitative aspects in any definition of science ascribe very little (...) that is truly scientific to biology in general or to its daughter medicine in particular. Jerome Frank comments approvingly that “many scientific-minded physicians today deny that medicine is, or is likely ever to be, a science.” Articulate physicians themselves may be highly critical. Dr. Ian Stevenson, for example, declares, “Medicine will not achieve the status of a science until the basic laws of health and disease have been disclosed. But the search for these laws has hardly begun.” Stevenson goes on to point out that instead of seeking basic laws, medicine is concentrating on facts, from which no laws emerge. (shrink)

Cet article discute le rôle des représentations dans les preuves mathématiques. Il est suggéré ici que les représentations nous permettent de diviser une preuve en plusieurs parties plus faciles à traiter. Nous illustrerons cela avec un exemple de la pratique mathématique actuelle qui consiste à trouver la valeur d'une expression en la divisant graduellement en parties plus simples. Par ailleurs, j'explique le rôle que jouent les icônes et les indices dans cette procédure. Les icônes assurent la similarité entre l'expression et (...) les résultats obtenus. En revanche, les indices agissent comme des indicateurs qui permettent de réinsérer les résultats aux emplacements appropriés. (shrink)

The position of clinical ethicist exists to help resolve conflicts in the hospital. Sometimes these conflicts arise because of fundamental cultural differences between the patient and the medical team, and such cases present special challenges. Should the ideology of modern medicine reject the wishes of those who hold ideologies from differing cultures? How can the medical ethicist help resolve such conflicts? To answer these questions, I rely on the works of Alasdair MacIntyre. Using MacIntyre’s philosophy, we can better understand why (...) traditions exist, how conflicts arise, and how opposing traditions can collaborate in shared decision making. In order to overcome conflict, I conclude that MacIntyre’s virtues of acknowledged dependence must be realized by the ethicist and those in disagreement over tradition. I use a case study of a young Amish patient to highlight the conflicts that arise and to help exhibit how shared decision making can be made possible. (shrink)

In the context of animal experimentation, laboratory workers fluctuate between seeing animals used in research as tools or objects and seeing them as sentient living beings. Most laboratory workers do not wholly lose their empathy and their ability to connect with other living beings. To deal with the fact that their job involves harming and killing animals on a regular basis, they employ various coping strategies, such as rationalizing the use of animals in research and minimizing their emotional attachment to (...) the animals. The evidence compiled in this article suggests that researchers, technicians, and caregivers who are involved in animal experimentation experience stress, anxiety, guilt, and trauma. I conclude that inflicting pain and death on nonhuman animals causes laboratory workers to suffer as well. Thus, in animal research, the suffering of nonhuman animals and humans is directly linked. The consideration of human suffering adds another dimension to ethical discussions of animal research, namely the relation between the suffering of human and nonhuman animals. A comprehensive ethical discussion of animal experiments should therefore include the suffering of nonhuman animals, the suffering of humans, and the relation between the two. (shrink)
